Which rights does the European law grant me?
Each European country has its own labour law with specific conditions.
Still there are some general rules that apply to all transport workers in Europe through the European Mobility Package:
- It is illegal to be paid by the kilometre you drive.
- The base of operations of the employer and the contracts should be in the country where the majority of the transport operations are conducted.
- Each driver is entitled to return home at least every 3 weeks, the company must schedule this, so it is possible for the driver!
- Each driver is entitled to a hotel, paid for by the employer, when he takes his normal weekly rest and is not at home. It is illegal to take the weekly rest (a rest of more than 40 hours) in the cabin of the truck!
- If you perform cabotage operations in a country with a higher minimum wage and benefits than your contract, you are entitled to these higher wages and benefits during the time of the cabotage operation
